1. About these terms

These Terms of Service ("Terms") govern your use of neximmedical.com and related Nexim websites (the "Site") and any purchase you make through it. The Site is operated by Nexim Direct LLC ("Nexim", "we", "us"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

2. Nexim is not a medical provider

Nexim does not provide medical care, diagnosis or treatment. Content on the Site, including product descriptions and community posts, is for general information only and is not medical advice. Always talk to a qualified healthcare professional about your health, and before starting any new product. In an emergency, call 911.

3. Finding a doctor

The Find a Doctor section lists independent physicians and practices. They are not employed or supervised by Nexim, and each is solely responsible for the care they provide. When you book, you are taken to the practice's own booking system and your relationship is directly with that practice. Nexim does not collect your medical information and does not receive or pay any fee for patient referrals.

4. Eligibility and accounts

You must be at least 18 years old to buy from the Site. If you create an account, keep your login details secure and tell us promptly about any unauthorized use. You are responsible for activity under your account.

5. Products, pricing and availability

We try to describe and price products accurately, but errors can happen. Product images are for illustration. Prices and availability may change without notice. If a product is listed at an incorrect price, we may cancel the order and refund you. Products are intended for use as directed on their labels.

6. Orders and payment

Your order is an offer to buy. We may accept or decline any order, limit quantities, or cancel an order (for example, for suspected fraud or a pricing error). You agree to provide current, complete and accurate purchase information. Payment is processed securely by our payment providers; we do not store full card numbers.

7. Shipping and returns

Shipping and returns are covered by our Shipping Policy and Return and Refund Policy, which form part of these Terms.

8. Practice accounts

Physician practices that buy under a practice account may receive practice pricing and may be covered by a separate account agreement. If that agreement conflicts with these Terms, the account agreement controls for those orders. Practice pricing is never tied to referrals or to purchases made by a practice's patients.

9. Community and submissions

If you post in the Nexim Community or send us ideas or innovations, you confirm you have the right to share them and that they are lawful, respectful and do not include anyone's private health information. Please do not post your own personal medical details. We may moderate or remove content at our discretion. You keep ownership of what you submit, and you give Nexim a non-exclusive licence to display it on the Site. Submitting an idea does not create a confidentiality or business relationship unless we agree in writing.

10. Intellectual property

The Nexim name, logos and Site content belong to Nexim or its licensors. You may not copy or use them without our written permission.

11. Prohibited use

You agree not to misuse the Site, including attempting to interfere with its operation, access it by automated means without permission, or use it for any unlawful purpose.

12. Disclaimers

The Site and products are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Manufacturer warranties, where offered, are provided by the manufacturer.

13. Limitation of liability

To the fullest extent permitted by law, Nexim will not be liable for any indirect, incidental, special or consequential damages, and our total liability for any claim relating to the Site or a product is limited to the amount you paid for that product. Nothing in these Terms limits liability that cannot be limited by law.

14. Indemnity

You agree to indemnify Nexim against claims arising from your breach of these Terms or your misuse of the Site.

15. Governing law

These Terms are governed by the laws of the state in which Nexim Direct LLC is organized and applicable US federal law, without regard to conflict-of-law rules.

16. Changes

We may update these Terms from time to time. The version posted on the Site, with its "last updated" date, applies to your use at that time.
